Cancellation Policy & Right of Withdrawal

Right of Withdrawal Consumers have a statutory right of withdrawal. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

Withdrawal Period You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.

by means of a clear declaration (e.g., a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exclusion or Premature Expiry of the Right of Withdrawal

The right of withdrawal does not apply to or expires prematurely for the following contracts:

Contracts for the supply of sealed goods which are not suitable for return due to reasons of health protection or hygiene if they have been unsealed after delivery. This applies in particular to test kits for sample collection (e.g., stool sample kits) supplied by Bactera GmbH. As soon as the safety seal or the sterile packaging of the test kit or its components (e.g., tubes, buffer solution) has been opened after delivery, a return is strictly excluded. In this case, no refund will be issued.

Contracts for the supply of services (e.g., laboratory analysis), if the service has been fully performed and the performance of the service began only after you gave your express consent and confirmed your acknowledgement that you lose your right of withdrawal once the contract has been fully performed by us.

Contracts for the supply of digital content (e.g., digital reports, e-books) which is not supplied on a tangible medium, if the performance has begun with your prior express consent and your acknowledgment that you thereby lose your right of withdrawal.
